Special Terms of WhatsApp Business Solution
1. WhatsApp Business Terms
Before using our Services, you agree to be bound by the WhatsApp Business Solution Terms, the WhatsApp Business Terms of Service, and WhatsApp’s technical documentation, as varied by these Terms. You represent that you have read and reviewed these documents. In case of conflict between these Terms and WhatsApp’s terms, these Terms will control to the extent of such conflict.
2. Facebook Requirements
WhatsApp works with Facebook to provide the tools required for WhatsApp Business Solution. You agree to comply with the Facebook Terms and Facebook Commercial Terms applicable for Facebook Business Manager and Facebook Developer. Users must also comply with the WhatsApp Terms for Service Provider.
3. Policy Updates
Facebook and WhatsApp reserve the right to change their terms, conditions, and policies. It is your responsibility to stay informed about these changes and ensure compliance with the updated requirements.

You may not send unsolicited messages or SPAM through the WhatsApp platform. WapShark reserves the right to immediately suspend your services if there is reason to suspect fraudulent, unlawful, or unauthorized use until such conduct has ceased.
6. Compliance Requirements
You must maintain appropriate administrative, physical, and technical safeguards that meet industry standards, comply with applicable laws, and are designed to prevent unauthorized access, use, or disclosure of user data. You must immediately notify WapShark of any data breach and take appropriate remedial actions.
7. Account Migration
If you request to migrate your WhatsApp Business Account (WABA) to another Solution Provider, WapShark will support your migration in a timely manner (not exceeding thirty days following notice), contingent upon fulfillment of all payment obligations.
8. Service Termination
Facebook and WhatsApp may at any time prohibit your use of the WhatsApp Business Solution, effective upon notice to you. WapShark also reserves the right to limit, suspend, or terminate your access if necessary to protect system integrity, comply with laws, or prevent harm to any parties.
9. Government Use Restrictions
You must NOT use or access the WhatsApp Business Solution if you are a Governmental Authority or for any client that is a Governmental Authority, except with express prior written approval from WhatsApp.
10. Indemnification
You agree to defend, indemnify, and hold harmless WapShark, Facebook, WhatsApp, their affiliates, and their respective officers, directors, employees, and agents from all liabilities, damages, losses, and expenses relating to your access or use of the WhatsApp Business Solution, your breach of these Terms, or any misrepresentation made by you.
